By virtue of an Order of the Court in the above referenced matter, Auction Advisors was appointed Special Master and will expose the property in Somerset County commonly known as, and located at, Unit 7, 33 River Birch Circle, Montgomery, New Jersey, also identified as Lot 20.02 Qual. CONDO, Block 37006, with the nearest cross street of Scarlet Oak Drive, to sale at public venue on March 18, 2021 at 12:00 PM (prevailing time). The auction sale will be held on-site at the property. The Property will be open for inspection 1 hour before the auction and as otherwise set by the Special Master.
THE PROPERTY IS A DEED RESTRICTED AFFORDABLE HOUSING UNIT. THE DEED RESTRICTION WILL SURVIVE THE SALE. BIDDERS MUST BE PREQUALIFIED BASED ON INCOME STANDARDS PROMULGATED BY COMMUNITY GRANTS, PLANNING AND HOUSING (“CP&H”), THE AFFORDABLE HOUSING ADMINISTRATOR FOR MONTGOMERY TOWNSHIP. THE UNIT MUST BE OWNER OCCUPIED
Surplus Money: If after the sale and satisfaction of the mortgage debt, including costs and expenses, there remains any surplus money, the money will be deposited into the Superior Court Trust Fund and any person claiming the surplus, or any part thereof, may file a motion pursuant to Court Rules 4:64-3 and 4:57-2 stating the nature and extent of that person's claim and asking for an order directing payment of the surplus money. The Special Master or other person conducting the sale will have information regarding the surplus, if any. The sale will be subject to any unpaid taxes, municipal liens or other charges and any such taxes, charges, liens, insurance premiums or other advances made by plaintiff prior to this sale.
